Option A: Sample staff contract copyright clause Use of staff copyright material Between ............................... staff member and ............................... school Acknowledging that: On commencing employment the school would take continuing benefit from the previous intellectual output and experience of the staff member and that in the event of the staff member leaving the school would need to continue to use material created while the staff member was employed and that the staff member would want to also use the material as a base for continuing teaching research and publications. The parties contract as follows: The staff member undertakes they own the copyright or a licence to use any teaching material brought into the school by that staff member. That the school owns the copyright in all teaching and educational material created by the staff member while the staff member is employed at the school. The staff member waives their right to be identified as author where any material is revised beyond the second revision where the staff member is not the author of the revision. The school grants a licence to the staff member to use any material created by the staff member while employed at the school in the period subsequent to that employment on the condition that it be used in teaching or for an educational purpose and subject to the following clause. The staff member undertakes to acknowledge the school in any publication where any work created while employed by the school is used. Option B: Sample staff contract copyright clause Use of staff copyright material Between ............................... staff member and ............................... school Acknowledging that: On commencing employment the school would take continuing benefit from the previous intellectual output and experience of the staff member. And that in the event of the staff member leaving the school would need to continue to use material created while the staff member was employed. And that the staff member would want to also use the material as a base for continuing teaching research and publications. The parties contract as follows: The staff member undertakes they own the copyright or a licence to use any teaching material brought into the school by that staff member. That the staff member owns the copyright in all teaching and educational material created while employed at the school. The staff member grants the school a licence to use the material in clause (above number) within the school for educational purposes, to adapt the material subject to an obligation to identify the staff member as author for all unadapted use and for two revisions where the staff member is not the author of the revision. The staff member undertakes to acknowledge the school in any publication where any work created while employed by the school is used, this undertaking to continue for 5 years after ceasing employment.
